The purpose of this policy is to outline the requirements of the Federal Fair Labor Standards Act as it applies to Hamra Enterprises.

All jobs will be classified exempt (management) or non-exempt (hourly associate).

Our restaurants adhere to the current federal minimum wage. When federal and state minimum wages differ, the higher wage is paid.

Overtime must be paid to non-exempt associates for all hours worked over 40 per workweek. (If state law differs from the federal law, the law that results in the higher overtime pay to associates is the law that must be observed).

An established workweek is a fixed and regularly occurring period of 168 hours – seven consecutive 24-hour periods.

Federal and state law requires the following information:

  • Address
  • Occupation
  • Rate of pay
  • Scheduled earnings
  • Date of birth
  • Sex of individual
  • Time of day
  • Day of week when employee’s workweek begins
  • Hours worked each workday
  • Overtime earnings for the week
  • Daily or weekly base earnings
  • Wages paid each pay period
  • Date of payment
  • Pay period covered by payment
